Is this you?

You may need spousal support paperwork if…

  • You stayed home to raise the children and now have little or no income.
  • Your spouse earns much more and moved out, and the bills are piling up.
  • You and your spouse agreed on support and need it written into the judgment correctly.
  • You were served with a request for support and need to file your own Income and Expense Declaration.
How it works

Five steps with Rosa

  1. Tell Rosa your situation. Walk in, call, or book online; you explain what you and your spouse need.
  2. Gather your numbers. Recent pay stubs, your last two tax returns, and your monthly expenses.
  3. Rosa prepares your forms at your direction. FL-150, FL-300, or your agreed support terms — you review every page before signing.
  4. File with the Santa Clara County Superior Court. At the Family Justice Center, 201 N. First Street, San Jose, with the fee or a fee-waiver request.
  5. Serve and follow through. Your spouse is served, and the court sets a hearing or approves your agreement.

Why Rosa

Accurate numbers, clearly explained

Support requests rise or fall on the Income and Expense Declaration. A missing expense or wrong income figure can hurt your request or delay your hearing. Rosa checks every page with you, explains it in plain English or Spanish, and never pushes you toward an amount — the decision is yours or the judge’s.

Common questions

Spousal support questions, answered

What is spousal support in California?

Spousal support, also called alimony, is money one spouse pays the other during or after a divorce or legal separation. It can be temporary while the case is open, or long-term in the final judgment.

How do I ask for spousal support during my divorce?

You file a Request for Order (Form FL-300) with an Income and Expense Declaration (Form FL-150) in your divorce case, and your spouse is served. The court then sets a hearing. Expert Multi-Services prepares these forms at your direction after a consultation.

What is temporary spousal support?

Temporary spousal support is support ordered while the divorce is still pending, to help the lower-earning spouse keep up with living expenses. It lasts until the judgment or a new court order.

How is spousal support decided in California?

Spouses can agree on support in writing. If they do not agree, courts commonly use a guideline calculation for temporary support, and for long-term support the judge weighs the factors in Family Code section 4320, such as each spouse’s earning ability, needs, and the length of the marriage.

How long does spousal support last in California?

For marriages under 10 years, long-term support often lasts about half the length of the marriage. For marriages of 10 years or more, there is no set end date and the court may keep authority over support. Spouses can agree to a different term in writing.

Does spousal support end if my ex remarries?

Unless you agreed otherwise in writing, California spousal support ends when the spouse receiving support remarries or when either spouse dies.

Can Rosa tell me how much spousal support I should get or pay?

No. A Legal Document Assistant cannot give legal advice or recommend an amount. You and your spouse decide the terms, or the judge decides. Rosa prepares your forms with the figures and terms you provide.

What forms are used for spousal support?

The main forms are the Income and Expense Declaration (FL-150) and the Request for Order (FL-300). When spouses agree, the support terms are written into the divorce or legal separation judgment.

Can we agree on spousal support without a court hearing?

Yes. Spouses can put an agreed amount and duration in writing and include it in the judgment for the judge to approve. Rosa types your agreed terms into the correct paperwork.

How much does spousal support paperwork cost in San Jose?

Every spousal support case is different, so Rosa reviews your situation and explains the cost at a consultation before any work begins. Call (408) 766-3529 to schedule. Court filing fees are separate, and fee waivers may be available if your income is low.

Is spousal support the same as child support?

No. Child support is for the children and follows a statewide guideline formula. Spousal support is for a spouse and follows different rules. A case can include both.

I stayed home with the children and have no income. Can I still ask for support?

Yes. You can ask for spousal support. The court considers each spouse’s earning ability and contributions to the marriage, including caring for the home and children.

What if my spouse stops paying court-ordered support?

If support is in a court order, you can ask the court to enforce it. The Santa Clara County Superior Court Self-Help Center can explain enforcement options, and Rosa can prepare forms at your direction.

Do I need a lawyer for spousal support?

California does not require a lawyer to request or agree on spousal support. If your spouse disputes support or the case is complex, consulting an attorney is a good idea. Expert Multi-Services prepares documents but cannot give legal advice or represent you.

Do you help with spousal support in Spanish?

Yes. Rosa is a native Spanish speaker and explains every spousal support form in Spanish. Se habla español.

Can I walk in today or book online?

Yes. Walk-ins are welcome Monday through Friday, 10 AM to 6 PM, at 434 Blossom Hill Rd, San Jose. You can also book online or call (408) 766-3529.
