How it works

Five steps with Rosa

  1. Meet with Rosa. Walk in, call, or book online, alone or together.
  2. Rosa prepares your Petition at your direction. Alone (FL-100) or together (FL-700).
  3. File with the Santa Clara County Superior Court. At the Family Justice Center, 201 N. First Street, San Jose, with the fee or a fee-waiver request.
  4. Exchange financial disclosures. Rosa prepares each spouse’s forms.
  5. Sign your agreement and submit the judgment. Your marital status can end no sooner than six months after the case begins.

Agreement still has to be written correctly

Even when you agree, the court needs your custody schedule, child support, property, and debts written on the right forms. Missing pieces can send your judgment back for corrections. Rosa checks every page with you before it is filed.

Common questions

Uncontested divorce questions, answered

What is an uncontested divorce in California?

An uncontested divorce is one where both spouses agree on every issue, including property, debts, support, and custody if there are children. Because nothing is in dispute, no trial is needed.

How much does an uncontested divorce cost in San Jose?

Expert Multi-Services prepares an uncontested divorce for a flat $1,200 without children, or from $1,700 with children and assets. Court filing fees are separate, and fee waivers may be available.

How long does an uncontested divorce take in California?

California has a six-month minimum waiting period before a marriage can end, counted from when the case begins. Complete, accurate paperwork helps avoid delays beyond that.

What is the difference between an uncontested and a contested divorce?

In an uncontested divorce the spouses agree on everything. In a contested divorce they disagree on at least one issue, which can require hearings or a trial and usually costs more.

Can we get an uncontested divorce if we have children?

Yes. Parents can have an uncontested divorce when they agree on custody, visitation, and child support. The agreement is written into the judgment for the judge to approve.

Do we have to go to court for an uncontested divorce?

Often, no. Many uncontested divorces are completed by submitting the paperwork for the judge to review, without a trial. The court can still ask for corrections or a hearing if something is missing.

What forms are needed for an uncontested divorce?

The main forms are the Petition (FL-100) and Summons (FL-110), or the Joint Petition (FL-700), plus financial disclosures (FL-140, FL-142, FL-150), a written settlement agreement, and the Judgment (FL-180).

Can we file an uncontested divorce together?

Yes. Since January 1, 2026, spouses who agree can file one Joint Petition (Form FL-700) together, so neither spouse has to serve the other.

What if we agree on most things but not everything?

Then the case is contested on the issues you disagree about. Many couples use mediation to reach agreement. Expert Multi-Services prepares contested divorce paperwork from $2,500, and an attorney can advise on the disputed issues.

What is a marital settlement agreement?

A marital settlement agreement is the written contract that lists everything you both agreed on, such as property, debts, support, and custody. It becomes part of your divorce judgment.

Can one document preparer work with both of us?

Rosa prepares the documents based on the terms you both agree on, but she does not represent or advise either spouse. Each spouse may consult their own attorney for legal advice at any time.

Is an uncontested divorce cheaper than hiring a lawyer?

Usually, yes. San Jose divorce attorneys commonly bill $300 to $450 per hour, while Expert Multi-Services prepares an uncontested divorce for a flat fee starting at $1,200.

We got married in Mexico. Can we get an uncontested divorce in San Jose?

Yes. Where you married does not decide where you divorce. If one spouse has lived in California for 6 months and in Santa Clara County for 3 months, you can file here. Bring your marriage certificate.

Do I need a lawyer for an uncontested divorce?

California does not require a lawyer for an uncontested divorce. If you want advice on whether your agreement is fair, consult an attorney. Expert Multi-Services prepares documents but cannot give legal advice.

Do you help with uncontested divorce in Spanish?

Yes. Rosa is a native Spanish speaker and explains every uncontested divorce form in Spanish. Se habla español.

Yes. Walk-ins are welcome Monday through Friday, 10 AM to 6 PM, at 434 Blossom Hill Rd, San Jose. You can also book online or call (408) 766-3529.
